“Do union activists have the right to invade a business owner’s private property? The Supreme Court just rejected a California regulation and answered the question with a resounding “no.””
Good.
“The three liberal-leaning justices argued that this regulation doesn’t count as a “taking” of property, because the state is not literally taking it away, but merely regulating its use. ”
Shocking.
Would they say it is not a “taking” if someone “regulated” the use of your car or house by allowing someone to rekey them and use it as if they owned it?
If your idea of “regulation” is “whatever the party in power wants to do”, then where exactly is the limit?
The fundamental property right is the right to exclude.
It will be interesting indeed when this decision is cited for the proposition that the public accommodation laws are an illegal taking.
I was just thinking the same thing.
The decision did state there is a difference for private property that is generally open to the public.
“the state is not literally taking it away, but merely regulating its use”
If you can’t use your property as you see fit, which includes prohibiting and ejecting people, then it is indeed being taken to some degree.
It’s not a taking if we mandate you allow people in for 3 hours a day to harass your employees.
“the state is not literally taking it away, but merely regulating its use.”
So you dont get to use it as you see fit, you just get to pay the taxes on it. Those are not liberal leaning justices, they are fascist pigs that need to get their asses peppered up real good with some bird shot. Now get your asses off of my lawn.
Shocking.
What, that it was only those 3 that saw it that way? Yeah that is kinda shocking.
The federal courts, particularly SCOTUS, are our best hope in these dark times. That’s why they so want to pack the court.
By this reasoning, basically all government action would be considered legal, since it can all be rephrased as regulation, and the regulatory power is nearly unlimited. The only exceptions would be whatever the Cathedral holds dear, which would be sacrosanct until it changes again next week.
The three liberal-leaning justices argue like toddlers.

I was going to say I haven’t been to the theater since 2008.
The idea of paying an ever increasing amount of money to be stuck in a public space, potenitally with other people, that is often in an unsanitary condition, with no ability to even pause the content should I need to use the restroom, well, I don’t see the appeal.
^This^
My last one in the theater was Half Baked, a good one to go out on. Sticky floors and massively overpriced snacks just don’t cut it anymore.
About the same here. I can’t remember when or what it was, but it was at least a decade ago.
Well, an inch of rain just fell in about 15 minutes. Impressive.
Ever been to Florida, k?
After 3 or 4 weeks of drought, any rain is impressive.
And we get plenty of thunderstorms on the plains that can drop 3 to 4 inches in under an hour.
Today was clear skies; pouring rain; and clearing skies in less than 45 minutes. Pop-up storms are cool as long as you’re not out on the back nine.
Ah, forgot that much of the west is/was under drought. Glad that no longer includes you.
1.29 inches in about 45 minutes. This is on top of 3 inches spread over the previous 4 days. The good news is the ground should be pretty soft after the previous rain, so this downburst should mostly soak in instead of running off.
We were at a deficit of 7 inches of rain just 5 days ago. Getting caught up now.
When I lived in Tejas, we’d have scorching hot summer days w/humidity (Central Texas). Then a pop-up downpour would appear and rain buckets for 15 minutes or so. It would leave, the sun would come back out, and turn the place into a proper sauna.
Rinse/repeat.
We get those when the dew point rises to the upper 70s. Miserable weather.
When I was in college, we didn’t have air conditioning.
We get up in the morning and leave footprints in the dew on the carpet in the living room.
*Looks out the window*
Hmmph. That aint just central Texas.
That’s the forecast for next Monday-wednesday here. Upper 80s/low 90s with pop up storms.
Right now, it’s not too bad sitting out in the shade in the backyard even though it’s 95 or so. Nice breeze, low humidity. I’m halfway to convincing myself to fill up the kiddie pool with water and dangling my feet in there.

The three liberal-leaning justices argued that this regulation doesn’t count as an “infringement” on the right to keep and bear arms, because the state is not literally taking it away, but merely regulating its use. However, as the Wall Street Journal editorial board notes, such a narrow and limited view of RKBA contradicts the Founders’ vision and would negate landowners’ fundamental rights.
Maybe Limey knows, but in the UK isn’t there a right to cross privately owned land? I can see that as being a necessary thing where all the land surrounding your hamlet was owned by the local baron.

Police shut down areas in the central district of Würzburg, south-central Germany, on Friday afternoon in response to an apparent knife rampage. Early reports from local German-language news sources indicate that police shot the suspect in the course of ending the attack, but not before at least two, and perhaps three people were killed and several more injured.
No information about the motive of the attack or the identity of the killer is yet in the public domain.

Ok, when one does a wire transfer and their bank tells them that it will cost a $30 fee, usually one would expect that the $30 fee would be tacked onto the withdrawal from the account, not removed from the amount transferred, right?
Effing Cap1….
Its two separate transactions, so I would expect two entries. I would not expect them to reduce the effing wire transfer amount, which is . . . whatever is beyond idiotic.
+1
[slightly sinister German-Swiss accent]But it’s a wire transfer, not a vulgar, pedestrian e-check. We have to charge extra for that. Because, reasons.
Ugh. Reminds me of how I ended up with fractional shares worth a couple of dollars when transferring an account from MSSB. Their fees to liquidate and wire the money were well more than the remaining account was worth. I’ve left it for close to ten years. Oh, and it was a dividend yielding stock. So every quarter MSSB mails both a check for a couple pennies and a separate statement that they did so.
I think that happened when I wired the down payment on my house, but the bank warned me ahead of time so I could increase the amount transferred.
Why would a bank ever wire transfer any amount other than the precise amount requested? It shouldn’t even be an option, fer chrissake, for them to do anything else.
Fidelity does wire transfers for free, if you have accounts with them.
Good to know!
This. I am actually in the process of moving everything to Fidelity so I can have a one stop shop. They will refund all atm fees too (for the 3 times a year I pull out cash).
Only issue I am going to have is if I receive cash I’ll have no way to deposit it, but that should be a rare problem.
If they’re refunding ATM fees, I’m guessing they’re plugged in with one of the ATM provider groups. Probably can do basic deposits/withdrawals at almost any local bank.
PNC bank has an account with free outgoing domestic wire transfers.

God bless MSFT. I’ve just read three articles about Windows 11.
As it currently stands after multiple revisions of stories and spin from Redmond. You are going to need an 8th generation Intel processor or higher and on the AMD side similar era. Plus as best the herd can figure out TPM 2.0.
I have two systems – my everything desktop which is Gen 7 Intel and my gaming system which is an AMD 2700X. I’m fine on the AMD, but no TPM module. And from a hardware standpoint on the Intel system I should be fine, but I’m not sure if MSFT will let you upgrade unsupported. One story said yes another said no.
However, on both it looks like I’m going to need a TPM module. Prior to this they were $25 each and now I’ve already read about scalpers. I most certainly don’t need to upgrade either system in any kind of a hurry, but I’m annoyed about both requirements are they aren’t really required to run the OS.
That said i’ll probably buy the module at some point and upgrade the gaming system at least.
I read one earlier today. It said that MSFT is promoting TMP 2.0 as needed for Win11 while hiding the details that TMP 1.2 is good enough. Further, any modern CPU can do to TPM 1.2 with a BIOS setting.
https://www.theverge.com/2021/6/25/22550376/microsoft-windows-11-tpm-chips-requirement-security
Hidden away on Microsoft’s site is what’s really happening here — or so we thought, until Microsoft changed its page a couple hours after we published this story. According to the original version of the page, the true minimum requirements are TPM 1.2 and a 64-bit dual-core CPU that’s 1GHz or greater. Since TPM support can be enabled through practically any modern CPU in the BIOS settings of a machine, you shouldn’t need a separate module unless your CPU is very old.
But the new page says it requires TPM 2.0 and an processor that Microsoft has explicitly certified as compatible — which might mean everything before an 8th Gen Intel Core and AMD Ryzen 2000 won’t work. We’re following up with Microsoft now.
Yup.
I didn’t know Microsoft was that eager for so many people to switch to Linux.
The biggest reason I still use Windows is games, and there’s not many that can’t run on Linux in one form or another anymore.
I just downloaded Linux Mint onto an old computer and it works freaking great. It even runs Steam and my paid VPN with no issues. Fast as hell, no crashes, and free is hard to beat.
I bought a new computer about 2 years ago when I couldn’t update Win7 on my old one.
Fuck MSFT if they want me to buy a new one in the near future for Win11.
I don’t downgrade to the latest and worst version of windows until I have to. I certainly don’t buy hardware for windows.

By most rule books, singular nouns that end in -s take -‘s when made possessive. In practice, that mostly just covers proper nouns, since -s usually means plural.
e.g. Mr. Jones’s house vs. the Joneses’ house
The structure of the language that you grow up with strongly determines the structure of how one thinks. Also, the way the language is written influences the way one thinks. English is a bit of an odd language in the way it is structured because of the way it came about. This is why cultures using other languages can be so difficult to connect with.
I forgot to add that even people with a common language but different dialect can be difficult to connect with.

Taking away someone’s autonomy in order to take away their money is a crime whether you use a pistol or a judge. Someone should pay for what has been done to that girl.
Absolutely. It really is criminal what they’ve done, and by “they” I mean not just her father and lawyers but the judges and social workers and assorted government lackeys. More than a bit of sexism involved in it as well, I can’t imagine that happening to a male star in that way and I think most allegations of sexism tend to be without merit. Not here.
Some decades back there was a video of a man chasing another man around in front of a courthouse with a pistol and firing at him. Turns out it was a similar situation. The man being chased was the lawyer that had stolen the other man’s money.
When I told the people I worked with what I had seen they were horrified…until I told them the man being shot was a lawyer who had stolen money using the courts. Then my co-workers laughed and said “Oh, in that case, good.”
Heheh. I have no love for thieves. I do love a happy ending. I’m on a flight home now so I can’t easily look it up as the internet is slow, but there was a comment one of the judges made that would make your blood boil. It was as sexist as something you might hear in Saudi Arabia, not the US in present day.

See: Depp, Johnny
Some people wonder why Hollywood types are batshit crazy. They sold their souls. In Depp’s case he was not a child when he did it. Spears was a child and her soul was sold by her parent. I sometimes wish I believed in hell and that he and his ilk will burn in it.
The conservatorship began when she was 26.
It started long before then.
When Spears was eight, she and her mother Lynne traveled to Atlanta, Georgia, to audition for the 1990s revival of The Mickey Mouse Club. Casting director Matt Casella rejected her as too young, but introduced her to Nancy Carson, a New York City talent agent. Carson was impressed with Spears’s singing and suggested enrolling her at the Professional Performing Arts School; shortly afterward, Lynne and her daughters moved to a sublet apartment in New York.[25]
Spears was hired for her first professional role as the understudy for the lead role of Tina Denmark in the off-Broadway musical Ruthless!. She also appeared as a contestant on the popular television show Star Search and was cast in a number of commercials.[26][27] In December 1992, she was cast in The Mickey Mouse Club alongside Christina Aguilera, Justin Timberlake, Ryan Gosling, and Keri Russell.
How old was Depp in Nightmare on Elm Street?
Depp was just a druggie and a drunk who made terrible personal and financial decisions on his own that cost him most of his fortune. Spears is basically living as an indentured servant to her father. She is (or was) working a long running Vegas residency that is netting many millions per year and she is getting a couple grand stipend a month. She is forcibly on an IUD so she can’t have another kid even though she wants to. The story is utterly crazy.
Conservatorship laws in CA are totally fucked up. I have no doubt she is a victim. I have no problem letting people do strange assed shit. I have a huge problem with a court stealing all of their stuff and appointing another person to make all decisions for them. If they go broke because we left them alone, Oh well. I think in this case, dad wanted to make sure she didn’t go broke and he scammed the system into giving him absolute control over the whole shebang. Ain’t nothing more fucked up than that.
This patio . . . is dedicated to staff and is designed to create a peaceful place to gather, medicate or just have some quite time outside.

Listening to the full Dark Horse episode. What seems to be apparent is that the major pharmaceutical companies not only have full regulatory capture but also capture of the peer review and journal processes.
In addition to the resistance to repurposed drugs, this would explain quite a bit about the journals’ behavior last year re Trump. The pharma companies hated him.

Good grief, what’s going on there?
I am literally the only person in the entire world who wants more Iron Fist. I would have been interested if this linked back into how that ended. Literally everyone who butts right in at any mention to tell me how “shit” it was never even watched the whole first season, let alone the second season. Seriously ended on a big high note. Really cool. But, that was the reason that Marvel Entertainment fast tracked the Shang Chi movie, because a few woke “critics” and “journalists” pissed and moaned about a white guy doing kung fu. Just a little cameo or a nod to that world would have been great. It seems like the Ten Rings would have some kind of dealings with The Hand, and the comic book team ups between Shang Chi and Danny Rand look like fun. Also Coleen was very nice, and her glowing sword gave me the nice feeling.
Why gweilo make kung fu on screen before chinee? That lacist.
My wife is 5′ tall and weighs 95 lbs if she drinks a big glass of water. She had polio as a child and her right arm is weak. She loves action movies because she finds them cathartic. She can’t do any of that stuff and she has no real life experience with violence. She can watch whatever she wants on the TV but I mostly dont watch.
A long time ago I was young and stupid enough to do as I was told. A lot of people got hurt and worse. A lot of things got broken. I came home and dope was cheaper and easier to get than before. I dont like to see portrayals of people doing horrible things to each other. Want to see a ‘shoot ’em up’? I will pass.
No Iron Fist for me.
I liked it more because it was properly weird and mysterious. Ostensibly you’d think it was just going to be a lot of fighting, but they did the mystery really well, and the character development was pretty good. Way more interesting than the other Netflix shows. Daredevil was okay, but they all suffered from being dragged out to 13 ep seasons, except Iron Fist season two which was much better for being shorter.
I just slogged through Daredevil. In retrospect, I should have just skipped any episode that dealt with Elektra.
My wife loves some violent movies as well. She’s 5’2″ and about 130 lbs. And she thinks she’s really mean and scary. But she is alone in believing that.

She has that quick Latin temper. Holy cow, I really hate that because I am so laid back. When we first start living together, she’d get really frustrated and demand to know why I won’t fight with her.
