There is no case or controversy to use the particular language, that’s why. It’s actually a sound basis – unless you want even more political litigation (and lots more lawyers).
There is controversy:
States will continue to pass unconstitutional laws, they’ll be enforced for several years until they get to the SC, they’ll be overturned at the SC, then they’ll pass effectively the same law with a few words moved around a day after the ruling and start the process over again. Not to mention this will cause retailers to close their doors while the case works it’s way through the system, which means they won’t be in business when the SC scribes the law down and won’t be able to obtain a license between the time that ruling comes and a new unconstitutional law is on the books.
They’re running an end-around on checks and balances because this court wants to respect tradition. What they should do is start pausing the implementation of all of these laws until they wind their way through the system and can be ruled on. That way the state is the one with the burden of proving their law is constitutional before it can be implemented, rather than have citizens and residents have their rights infringed upon while waiting for the court to throw it out.
So the problem is with who the voters in those states elect to their legislatures. No SC can ever fix that.
Theoretically, the Constitution provides the solution to elected officials who want to infringe on rights. It assumes that the voters will send people to the capitol who will want to do so.
The question is the practical mechanics of how that solution is implemented.
The SC can absolutely fix that by striking down unconstitutional laws. It’s pretty much their job description.
Without it, we have no checks and balances.
And they strike down those laws when a proper challenge is presented, not on the basis of granting injunctive relief.
In the pre-woke days, this would be referred to as having such an open mind that her brain fell out.

Considering the idiocy when it comes to labeling and advertising laws that the feds impose on the craft beer makers, I approve of AB-InBev getting beaten with the same laws the (most likely) lobbied for.
Two examples of breweries having labels rejected or requiring a change:
1) Left Hand brewing is a big supporter of the MS foundation (to the point of being a big sponsor of every one of the bike rides, and the CFO riding all of them). One year, they decided to release a beer tied into the MS foundation. They were going to donate a share of the sales proceeds to the MS Foundation, and they wanted to name the beer MS Gose Away (using the MS Foundation logo for the MS). The government rejected the name and label because “People might consider the beer a form of treatment for MS.” The beer was eventually released as Wheels Gose Around.
2) Lagunitas (currently owned by Heineken, but was independent at the time), released a beer named Wilco Tango Foxtrot. The initial name was Whiskey Tango Foxtrot, but the government made them change the Whiskey to something else, as customers might be confused into thinking the beer was a whiskey or a whiskey barrel aged beer.

That’s just for beers that are going to be distributed outside of the state they were produced in, or for beers sold in the states that offloaded their label approval to the federal government. Dems in NH did a very good job working same-day registration. They targeted unregistered voters this time around using abortion as the hook.
It worked. Some candidates I know who were at the polling places said early registration lines were long. Folks joining those lines heckled Republican candidates and people holding signs for Republican candidates. The heckling revolved around Republicans banning abortion.
The problem is that the Democratic mobilization campaigns were most interested in adding votes to the Democratic columns, rounding up votes from those unlikely to otherwise vote.

I watched this the other night. Apparently a newly found or restored documentary about Roger Penske and Mark Donohue in the early days. Even if you don’t know anything about racing it’s worth a watch. Penske wasn’t the only person to approach motor racing in a methodical and orderly fashion, but he pretty much made a science of it. Donohue’s body language in some of the interview segments is pretty interesting; he looks about like he’s being tortured.
A couple of interesting foreshadowings: Penske, at one point says, “Well, I’ll probably just keep doing this as long as I find it challenging” and Donohue says, “Well, you really don’t see very many 65 year old racing drivers announce their retirement, so I don’t know how long I will be able to keep this up.”
Prnske’s still on the timing stand 60 years later, and Donohue died in a race car.

This spring has been one disaster after another. Deck project goes off the rails. Find out big ash tree has emerald ash borers and will cost $$$ to get rid of. Now my boat has both a bad fish finder and a bad motor.

I was very doubtful because the carb had been replaced the year before. Took it for a test run and it seemed fine. Took it out the first time this year got 500 yards away from the landing and the same fucking problem with motor popped up again. Taking it back to the same mechanic today.
